Form BE–12C - This form is filed for a US affiliate that has total assets, sales or gross operating revenues, or net income of $60 million or less (positive or negative). Only selected data items on this form are filed for a US affiliate that has total assets, sales or gross operating revenues, or net income of less than $20 million (positive or negative).
Form BE–12 Claim for Not Filing - This form is filed if a US affiliate does not meet the requirements for filing the BE–12A, BE–12B, or BE–12C and was notified by BEA to file.

All entities subject to the reporting requirements are required to file, even if not contacted by the BEA. Willful failure to file the report can result in an additional fine of up to $10,000 and may lead to imprisonment of not more than one year. The due date for filing Form BE-12 is June 30, 2023.
